These terms form the contract between you and IceFishingAR S.R.L., trading as IceFishingAR ("we", "us"). Please read them before you pay a deposit — paying one means you accept them on behalf of everyone in your party.
1. Who these terms bind
The person who makes the booking is the lead traveller. The lead traveller must be at least 18 years old, confirms they are authorised to accept these terms for every guest in the party, and is responsible for passing on all information we send, for collecting payment from the party and for the accuracy of the details supplied to us.
2. Making a booking
- Enquiries are not bookings. Dates, beats and lodge space are held only once we confirm in writing.
- A booking exists when we issue a written confirmation and the deposit has cleared into our account.
- Prices quoted are per angler for the stated week, in United States dollars unless we state otherwise, and are valid for 14 days from the date of the quotation.
- Please check your confirmation immediately. Tell us within 72 hours if anything is wrong; corrections after that may attract supplier charges.
- Names must exactly match passports. Name changes on charter flights may be treated as a cancellation by the carrier.
3. Deposits and payment
| Stage | Amount | When |
|---|---|---|
| Deposit | 50% of the trip price | To confirm the booking |
| Balance | Remaining 50% | 90 days before arrival |
| Late bookings | 100% | At the time of booking, if within 90 days |
Deposits are non-refundable but may be transferable under clause 6. Payment is by international bank transfer; you are responsible for your bank's transfer and intermediary fees, and the amount we receive must equal the invoiced amount. If a balance is not paid by the due date we may treat the booking as cancelled by you and apply the charges in clause 6.
4. What is included
- Guided fishing for the number of days stated on your confirmation, at the guide-to-angler ratio quoted.
- Accommodation in the confirmed lodge or camp on the stated room basis.
- All meals at the lodge, soft drinks, and house wine and beer with dinner unless stated otherwise.
- Ground transfers between the arrival airport and the lodge on the scheduled arrival and departure days.
- Provincial fishing licence for the fished days.
- Use of boats, wading equipment and shared camp gear where the itinerary provides it.
5. What is not included
- International and domestic flights, and any airline baggage or rod-tube charges.
- Travel, medical, cancellation and curtailment insurance — see clause 8.
- Visas, passport fees, reciprocity charges and airport departure taxes.
- Personal fishing tackle, flies, waders and boots unless hired from us.
- Premium spirits, wine list purchases, laundry and personal purchases.
- Gratuities for guides and lodge staff, which are entirely at your discretion.
- Charter flights, extra nights in town and any excursions booked outside the itinerary.
- Costs arising from delayed, cancelled or missed flights.
6. If you cancel
Cancellations take effect on the day we receive written notice from the lead traveller.
| Notice before arrival | Charge |
|---|---|
| More than 120 days | Deposit retained; transferable to a future season within 24 months |
| 120–90 days | 50% of the trip price |
| 89–60 days | 75% of the trip price |
| Fewer than 60 days, no-show, or leaving early | 100% of the trip price |
If we are able to resell your place at the full rate, we will refund what we recover, less an administration fee of USD 250 per angler. You may also substitute another angler at no charge up to 45 days before arrival, subject to charter-carrier rules. Unused services, fished days lost to your own late arrival, and voluntary early departures are not refundable.
7. If we cancel or change your trip
We plan around fixed lodge capacity and rarely change anything. Where we must:
- Minor changes — a different room, a revised beat rotation, a change of guide or a shift in the daily schedule. We will tell you, but no compensation is due.
- Significant changes — a change of destination, a reduction in fished days, or a move to accommodation of a lower standard. You may accept the change, accept an alternative trip we offer, or cancel and receive a full refund of money paid to us.
- Cancellation by us — if we cancel for any reason other than force majeure or your non-payment, you receive a full refund of everything paid to us. That refund is the limit of our liability; we do not reimburse flights, insurance or other arrangements you made independently.
8. Travel insurance is mandatory
Comprehensive travel insurance is a condition of travelling with us. Your policy must cover medical treatment and repatriation from a remote location, trip cancellation and curtailment for the full value of your trip, delayed and lost baggage, and personal fishing tackle. We may ask for your policy number and emergency assistance line before departure and may refuse boarding of transfers without it.
9. Weather, water conditions and fishing results
Patagonia is wild country. Wind, rain, snow, drought, flood, algal bloom, low or coloured water, fire and road closures all occur and can affect access, comfort and catch rates. We will always work to put you on the best available water, but we sell guided access to it, not a guaranteed catch. No refund or credit is due for weather, water conditions or the number of fish landed. Guides may suspend fishing for safety at their sole discretion; that decision is final.
10. Fitness, health and safety
- Our trips involve wading in current, uneven ground, cold, strong wind, and long days far from medical facilities. The nearest hospital may be several hours away.
- You must tell us at the time of booking about any medical condition, medication, allergy, mobility limitation or disability relevant to your safety or catering. We treat this information under our privacy policy.
- You must follow all safety instructions from guides and lodge staff, wear a personal flotation device where required, and use eye protection when casting.
- We may decline or curtail participation, without refund, where in our reasonable judgement continuing would be unsafe for you or others.
11. Conduct and our right to refuse
Camps are small and shared. We may end a guest's trip immediately and without refund, and recover any consequential costs, where their behaviour is dangerous, abusive, illegal, damages property, or in our reasonable opinion is seriously spoiling the trip for others. Alcohol is served at dinner; anglers who are intoxicated will not be taken onto the water.
12. Licences, regulations and conservation
- All our fishing is catch and release with barbless or de-barbed single hooks.
- Fish must be kept in the water where possible, handled with wet hands and revived before release.
- Provincial regulations on gear, beats, hours and biosecurity — including boot and wader disinfection — are binding and take precedence over any itinerary.
- Breaching fishing regulations is your responsibility. Fines are payable by you.
13. Liability
We accept responsibility for the parts of your trip that we or our staff and directly contracted suppliers provide, where loss or injury is caused by our proven negligence, subject to the limits below. We are not liable for:
- Airlines, charter carriers and any service you booked yourself or through a third party.
- Loss of or damage to personal tackle, luggage, electronics or valuables, however caused.
- Indirect or consequential losses, including missed connections, loss of earnings or loss of enjoyment.
- Risks inherent in angling, wading, boating and remote travel that you voluntarily accept by taking part.
Where liability is established, it is limited in total to the amount you paid us for the trip. Nothing in these terms excludes or limits liability for death or personal injury caused by our negligence, for fraud, or for anything else that cannot lawfully be excluded.
14. Force majeure
We are not liable for failure to perform where it is caused by events beyond our reasonable control — including war, civil unrest, terrorism, strikes, epidemic or pandemic, government or border restrictions, volcanic ash, wildfire, earthquake, flood, extreme weather, fuel shortage, airport or airspace closure, or the failure of essential infrastructure. In those circumstances we will offer a credit for a future season, or refund such amounts as we are able to recover from our own suppliers, after deducting unrecoverable costs already committed.
15. Photography and images
Guides frequently photograph guests and fish. We may use these images in our marketing unless you tell us in writing that you would rather we did not — before, during or after the trip, at any time. Images you take remain yours; if you tag or share them publicly, you grant us permission to repost them with credit.
16. Complaints
Tell your guide or the lodge manager immediately, while there is still a chance to put things right. If the matter is not resolved on site, write to reservations@icefishingar.pro within 28 days of your return, quoting your booking reference. We acknowledge within 7 days and respond substantively within 28.
17. Governing law and jurisdiction
These terms are governed by the laws of the Argentine Republic, and the ordinary courts of the Province of Santa Cruz have jurisdiction. If you are a consumer resident in the European Union or the United Kingdom, this does not deprive you of the protection of mandatory consumer rules in your country of residence. If any clause is found unenforceable, the rest remains in force.
A note for the site owner: the deposit percentages, cancellation windows and liability caps above are common industry practice but are placeholders. Have them reviewed by a lawyer, matched to your public liability insurance, and aligned with what your lodges and charter operators charge you — otherwise a cancellation can leave you paying a supplier out of pocket.
